    Marijuana Ordinance Adoption & Updates

    2023 UPDATE:  THE CITY LIFTED THE 2022 MORATORIUM ON APPLICATIONS, AND AMENDED THE ZONING & MARIJUANA ORDINANCES (CITY CODE CHAPTER 30 & 31) PERTAINING TO SPECIAL EXCEPTION USE PERMIT APPLICATION PROCEDURES AND TIMELINES, APPLICABLE ZONING DISTRICTS, AND RELATED PROVISIONS (AS SHOWN HERE) THAT APPLY TO MARIJUANA ESTABLISHMENT LICENSES & OTHER SPECIAL PERMITS, AND APPLICANTS THEREOF. 

    IN 2022:  THE CITY COMMISSION PLACED A MORATORIUM ON NEW APPLICATIONS FOR RETAIL FACILITY LICENSES UNTIL JANUARY 2023.  HOWEVER, THE CITY IS STILL ACCEPTING APPLICATIONS FOR OTHER MARIJUANA LICENSE TYPES INCLUDING FOR GROW OPERATIONS, TESTING FACILITIES, AND SECURE TRANSPORT LICENSES.

    The City has approved amendments to City Code that allow marijuana establishments as Special Exception Uses (SEUs) in certain zoning districts — for a zoning permit application, click here.  The corresponding business application is provided here, and the city’s current recommended process (checklist) for new applicants is available here.

    Please note: while the map graphic of potential locations provides a reasonable depiction of viable areas for marijuana establishments (and the highlighted areas shown were based, in part, on zoning designations at the time the map was created; i.e., for city & planning commission discussions), the information presented on the maps is not part of the ordinance amendments for marijuana facilities and should NOT be considered an approval (or pre-approval) of zoning for marijuana establishments within the city.

     

    ___Unofficial Summary of main zoning provisions, following Ordinance 848 and Amendment 866.

    31-5.2 No marihuana establishment shall be located within 1,000 feet of an existing school, and no marihuana establishment will be located within 500 feet of a church or City park.

    31-4.3  Special Exception Use Permit Required – per Ordinance 847.  Each proposed marihuana establishment shall make an application for a special exception use (SEU) permit …and must have an approved SEU Permit for the particular zoning district in which they are applying.  For details, refer to Ordinance 847; linked above.

    ___Marihuana Retailers:  B-1, B-2, B-3*
    ___Marihuana Microbusinesses:  B-2, I-3, I-4
    ___Marihuana Safety Compliance Facilities:  B-2, B-3*, I-1, I-2, I-3, I-4
    ___Marihuana Secure Transporters:  I-1, I-2, I-3, I-4
    ___Marihuana Processors:  I-1, I-2, I-3, I-4
    ___Marihuana Growers (Class A):  I-1, I-2, I-3, I-4
    ___Marihuana Growers (Class B and C):  I-2, I-3, I-4
    * except for first block of N. Main St. (congested parking and per proximity to City park)

    Also, note that, per 31-5.2 – (E): Processor facilities shall not be within 500 feet of another processing facility or grower facility licensed under the MRTMA or MMFLA …and, conversely (F): Grower facilities shall not be within 500 feet of another grower or processor facility licensed under the MRTMA or MMFLA.

    Municipal License Renewals:

    Current Licensees: the renewal date for most marijuana establishments in the City of Three Rivers is the same as the state’s expiration date — i.e., as shown in record results on LARA’s General Search page (tip: search using Lic.#, business name or “49093” for zip code).  The city’s renewal application form is available online (here) and, in order to avoid any unexpected delays in recertification (e.g., involving updated documentation requirements), current license holders are encouraged to begin their renewal process two months prior to their expected renewal or expiration date.

    The City of Three Rivers is located approximately 20 miles south of Kalamazoo, MI. We were founded by settlers who used the Three Rivers to transport goods. The St. Joseph River and the Portage & Rocky Rivers all converge near the city center, making this area an ideal location for trading and commerce.
